The International Civil Aviation Organisation (ICAO) Legal Committee has recommended new guidance materials and a web-based tool to help countries to fulfil their obligations under Article 12 of the Chicago Convention. These recommendations were made during the Committee’s 40th Session, held between Oct. 26-30 2026 in Montréal, Canada.

New Guidance to Support States
The ICAO Legal Committee endorsed practical guidance documents and an online tool designed to assist States in enforcing the “Rules of the Air,” as outlined in Article 12 of the 1944 Convention on International Civil Aviation (the Chicago Convention). Article 12 establishes each State’s responsibility to ensure compliance with the rules that govern how international flights operate.
The recommendations aim to reduce uncertainty and improve consistency for international operators in the enforcement of these rules. This new materials will be non-binding, serving as voluntary resources to help strengthen the implementation of the Rules of the Air across different jurisdictions.

What are the “Rules of the Air?”
The Rules of the Air are the international rules governing how aircraft operate and interact in the sky, established under ICAO Annex 2.
Article 12 emphasises that aircraft must comply with the applicable rules of the State whose territory they are flying over. States are also responsible for ensuring their own registered aircraft overseas comply with national regulations when operating abroad. Additionally, States should ensure the prosecution of persons violating applicable regulations.
The Committee’s proposed practical guidance documents and web-based tool are intended to support more consistent implementation of these obligations worldwide.
