LOT Polish Airlines has become the first airline to initiate legal proceedings against Boeing over the safety issues with its 737 MAX aircraft. The issues, centred around the aircraft’s Manoeuvring Characteristics Augmentation System (MCAS), led to two fatal crashes and caused the 737 MAX to be temporarily grounded worldwide. LOT is taking Boeing to trial due to the financial damage the airline sustained.

Why is LOT Polish Airlines taking Boeing to trial?
In 2019, the Boeing 737 MAX aircraft was grounded worldwide after two fatal crashes occurred. The crashes, which took place in Indonesia and Ethiopia, respectively, took the lives of 346 people in total.
It was later discovered that the fatal incidents were caused by a fault with the 737 MAX’s MCAS flight control system. The system was developed by Boeing to address an issue with the jet’s nose pitching up, but the safety flaw led to a faulty activation of the system that caused the plane in both cases to nose dive and crash, according to Reuters.
LOT Polish Airlines has said that it sustained significant revenue losses when the aircraft model was grounded worldwide, and in 2021 the airline sued Boeing for damages. Now, the airline is also claiming that Boeing was aware of the safety issue but failed to disclose this to LOT when it was sold a fleet Boeing 737 MAX aircraft in 2016.

What comes next?
The case is now taking place at the US District Court in Seattle, Washington, with proceedings beginning on Monday, May 12, 2026. According to Reuters, Anthony Battista, a legal representative for LOT Polish Airlines, stated:
“This case is about Boeing’s lies and deception and the devastating financial harm it caused.”
The legal case stems from allegations by LOT that the airline was deceived into believing that the Boeing 737 MAX was completely safe when the deal was struck between LOT and Boeing. However, a lawyer for Boeing has pushed back, accusing LOT of:
“Crying foul and fraud out of one side of their mouth in the courtroom.”
He continued by highlighting that LOT has continued to fly the 737 Max, adding:
“Is that how the victim of a multimillion-dollar fraud scheme behaves?”
The company previously told Reuters that it had already paid billions in compensation to the families of the crash victims. As of now, the case is still ongoing and no decision has been made on whether Boeing will have to pay compensation to LOT.
